Terms of Service & End User License Agreement (EULA)

Please read these Terms of Service and End User License Agreement (together, "Terms") carefully before downloading or using Terbius ("the Software"). By downloading, installing, or using the Software, or by using this website ("the Site"), you agree to be bound by these Terms. If you do not agree, do not download or use the Software.
The Software is provided by Vladimir Nahalka, based in the Slovak Republic ("we," "us," "our").
1. License Grant
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, worldwide license to download, install, and use Terbius, free of charge, for personal or professional purposes.
2. Restrictions
You agree that you will not, and will not permit others to:
- Sell, rent, lease, sublicense, or redistribute the Software as your own product.
- Reverse engineer, decompile, or disassemble the Software, except to the extent such restriction is prohibited by applicable law.
- Remove or alter any copyright, trademark, or other proprietary notices contained in the Software.
- Use the Software for any unlawful purpose or in violation of any applicable law.
Terbius makes use of certain third-party open-source components. Please see our [Third-Party Licenses] page for details, including components with their own license terms that may grant you additional rights with respect to that specific code.
3. Ownership
The Software is licensed, not sold. We (and our licensors, where applicable) retain all right, title, and interest in and to the Software, including all intellectual property rights, except for the third-party components identified in the Third-Party Licenses page, which remain the property of their respective owners.
4. Downloads and Email Registration
To download the Software, you must provide a valid email address, which we use to send you the download link as described in our [Privacy Policy]. You are responsible for providing accurate information and for keeping the download link confidential.
5. No Warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED. See our [Disclaimer] for further details, including limitations specific to 3D model viewing and measurement accuracy.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
7. Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must stop using the Software and delete all copies in your possession.
8. Changes to the Software or These Terms
We may update the Software or these Terms at any time. Continued use of the Software after changes to these Terms constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of the Slovak Republic, without regard to its conflict-of-law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Slovak Republic, unless mandatory consumer-protection law in your country of residence provides otherwise.
